Preamble

These Terms & Conditions (hereinafter “T&C”) apply to all sales of products concluded on the website https://delafinohouse.com.

The site is the property of the company Delafino House (hereinafter “the Seller”) in its entirety, as well as all related rights.

The customer (hereinafter “the Customer”) declares to have read these T&C before placing an order. The validation of the order therefore implies unreserved acceptance of these T&C.

ARTICLE 1 – PURPOSE

These T&C govern the contractual relationship between the Seller and the Customer in the context of the sale of products offered on the Site.

ARTICLE 2 – PRODUCTS AND PRICES

2.1 Products The products offered for sale are those listed on the Site on the day of consultation by the Customer, within the limits of available stock. The Seller takes the greatest care in the presentation and description of the products to best inform the Customer. However, errors or omissions may occur.

2.2 Prices Prices are indicated in Euros (€) and are inclusive of all taxes (VAT included) applicable on the day of the order. The indicated prices do not include delivery costs, which are billed as a supplement and specified to the Customer during the final validation of their order.

The Seller reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in effect at the time the order is validated.

ARTICLE 3 – ORDER

The Customer can place an order on the Site. The ordering process is as follows:

  1. Selection of products and addition to the cart.
  2. Validation of the cart’s content.
  3. Identification on the Site if the Customer is not already logged in.
  4. Choice of shipping method.
  5. Choice of payment method and acceptance of the T&C.
  6. Validation of payment.

The Customer will receive an order confirmation email summarizing the details of their order.

ARTICLE 4 – PAYMENT

Payment is due immediately upon ordering. The Customer can make the payment by credit card or any other means offered on the Site (e.g., PayPal, Stripe). Payments are secured by an online payment platform that guarantees the confidentiality of banking information. The Seller never stores credit card information.

ARTICLE 5 – SHIPPING

5.1 Shipping Zones Delafino House ships to the following countries: Belgium, France, Germany, Italy, Luxembourg, Netherlands, Portugal, and Spain (hereinafter “Europe”). We also ship to the rest of the world (hereinafter “International”).

5.2 Order Processing Times Every order is prepared with the utmost care. Please allow 1 to 3 business days for us to process and dispatch your order. This processing time is in addition to the carrier’s shipping time.

5.3 Shipping Methods and Times Once your order has been dispatched, the estimated delivery times are as follows. These are indicative and may vary.

  • Belgium: Delivery within 1 to 2 business days after dispatch.
  • Benelux (Netherlands, Luxembourg): Delivery within 2 to 4 business days after dispatch.
  • Neighboring Europe (France, Germany): Delivery within 3 to 6 business days after dispatch.
  • Rest of Europe (Spain, Italy, Portugal): Delivery within 5 to 10 business days after dispatch.
  • Rest of the World (International): Delivery within 7 to 21 business days after dispatch. Please note that this timeframe can be extended by your country’s customs procedures.

The Seller cannot be held responsible for shipping delays attributable to the carrier or customs clearance.

5.4 Shipping Costs Shipping costs are calculated automatically at checkout based on package weight and destination. They are indicated to the Customer before the order is confirmed. Free shipping is offered for all orders exceeding the amounts indicated on the Site.

5.5 Order Tracking Upon shipment of the order, a confirmation email will be sent to the Customer containing a tracking number, which will allow them to track the delivery of their package.

5.6 Customs Duties and Taxes (International Orders) For orders shipped outside the European Union, the Customer is the importer of record and must comply with all laws and regulations of the destination country. Customs duties, local taxes, or other import fees may be payable. These charges are not included in the order total and remain the sole responsibility of the Customer. Delafino House has no control over these charges and cannot predict their amount.

ARTICLE 6 – RIGHT OF WITHDRAWAL (EU CUSTOMERS)

In accordance with European legislation, the Customer has a period of fourteen (14) calendar days from the date of receipt of their order to exercise their right of withdrawal, without having to justify reasons or pay penalties.

To exercise this right, the Customer must notify their decision to withdraw by an unambiguous statement via email to hello@delafinohouse.com.

ARTICLE 7 – RETURNS AND REFUNDS

The procedures for returning products and the conditions for refunds are detailed in our Refund Policy, which is an integral part of these T&C. The Customer is invited to consult it to know the exact procedure to follow.

ARTICLE 8 – LEGAL WARRANTIES

All products supplied by the Seller benefit from the legal warranty of conformity as provided by law. In case of non-conformity of a sold product, it may be returned to the Seller who will take it back, exchange it, or refund it.

ARTICLE 9 – LIABILITY

The Seller, in the online sales process, is bound only by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other involuntary problems.

ARTICLE 10 – INTELLECTUAL PROPERTY

All elements of the Delafino House site are and remain the intellectual and exclusive property of Delafino House. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site.

ARTICLE 11 – APPLICABLE LAW AND JURISDICTION

These T&C are subject to Belgian law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, the competent courts will be the Belgian courts within the jurisdiction of the Seller’s registered office.

ARTICLE 12 – MODIFICATION OF THE T&C

The Seller reserves the right to modify these T&C at any time. The applicable conditions are those in force on the date of the order by the Customer.
